Consumer Notice Frequently Asked Questions

In order to understand how your personal information can or may be used by MVB Bank, the Bank is providing the following questions and answers.

Why does MVB send me a new privacy notice every year?

As your trusted partner, MVB Bank believes in safeguarding client information. Annual notification is required under the U.S. federal Privacy Law, also known as the Gramm-Leach-Bliley Act. We are required to let you know the different situations in which we share your information. We will provide you our updated Privacy Notice each year, as long as you maintain a relationship with us.

How does MVB Bank use my personal information?

MVB Bank uses client information for everyday business purposes. We process your transactions, maintain your account(s), respond to court orders and legal investigations or report to credit bureaus. We also use your information to offer our products and services to you and share such relevant information with our affiliates for everyday business purposes, see question below for further details.

Does MVB Bank share my information with business partners and affiliates?

Yes. Client information is shared with MVB business partners and affiliates for the following purposes:

  • To market the bank’s own financial products or services
  • To process and service transactions the consumer requests or authorizes
  • To protect against potential fraud or unauthorized transactions
  • To respond to judicial process
  • To comply with federal, state, or local legal requirements

What are affiliates?

Affiliates are companies related by common ownership or control. They can be financial or nonfinancial companies.

Our affiliates include companies with a subsidiary relationship to MVB and others, such as: Warp Speed Holdings LLC; MVB Edge Ventures, Inc; Victor Technologies, Inc; MVB Technology, LLC; Trabian Technology, Inc; MVB Insurance, LLC; Potomac Mortgage Group; lntercoastal Mortgage (dba MVB Mortgage in West Virginia only); and Paladin Fraud, LLC.

Does MVB share my information with nonaffiliates?

No. MVB Bank does not share information about you with nonaffiliates and does not sell client information.

Can I further limit having MVB Bank share my information?

No. The information we share today is for everyday business purposes and allows us to offer you valuable products and services.

Why can’t I limit all sharing?

Federal law gives you the right to limit:

  • Sharing for affiliates’ everyday business purposes – information about your creditworthiness
  • Affiliates from using your information to market to you
  • Sharing for nonaffiliates to market to you.

However, we do not share in these categories.

How do MVB and I benefit when you share my information among your affiliates?

We may be able to give you better client service, convenient access to our services and a wider range of products if we can share your information among our affiliates (companies we own or control). The better we know you, the easier it is to offer you financial products and services suited for your lifestyle.

Does the Privacy Notice cover all my MVB Bank accounts?

All MVB consumer accounts are covered by the notice. Non-personal and commercial accounts are not covered by the notice; however, we treat all client information with high security and confidentiality.

Does the Privacy Notice apply when I’m doing business online?

Yes, if you’re our client and a consumer, the Privacy Notice governs all of our interactions with your personal information. For that reason, our websites include links to the Privacy Notice, which explains how we protect your information when you bank with us. If you aren’t our client, the Privacy Notice doesn’t apply to you. You’re still subject to our Online Site Terms, however.

Do you ever make changes to your privacy notice?

We review our privacy notice at least annually to ensure it continues to align with our practices and provides clear and current information on how we use information collected from or about you. The updated notice reflects the results of our recent review. Since 2020, we have added information on affiliates that have joined the MVB family. When we do make changes or updates, we will also update the effective date of the notice, which is indicated at the top of the notice.

I have opted out before – did you update your Privacy Notice?

Yes. We previously were collecting opt out requests. However, we updated our Policy Notice in June 2021 to restrict sharing for all consumers in these categories and you no longer need to opt out.

How do I opt out of promotional emails you send me?

Our emails include instructions for telling us you don’t want to get any more of our promotional emails. These instructions are usually at the bottom of the email offer. Also, you may visit our Marketing Preference Center to submit your marketing preference request.

How do I submit a California Consumer Privacy Act (CCPA) Request?

If you are a California resident, please visit our online MVB California Consumer Request Form at MVB California Consumer Request Form. Answer the questions within the online form and submit the completed form to a request.

How does the federal Gramm-Leach-Bliley Act (GLBA) affect my rights under the California Consumer Privacy Act (CCPA)?

The CCPA exempts the data that is covered by the GLBA; specifically, “personal information collected, processed, sold, or disclosed pursuant to the federal Gramm-Leach-Bliley Act, and implementing regulations . . . .” Therefore, any data covered by the GLBA will not be controlled by your requests submitted to MVB and our responses may be more limited than other non-financial institutions.
